These Terms of Service govern your use of the Small HOA platform. By creating an account or using our services, you agree to these terms.
1. Acceptance of Terms
By accessing or using Small HOA, you agree to be bound by these Terms of Service. If you are using the platform on behalf of a homeowners association, you represent that you have the authority to bind that organization to these terms. If you do not agree, you may not use the platform.
2. Description of Service
Small HOA is a cloud-based management platform designed for small, self-managed homeowners associations. The platform provides tools for dues collection, member communication, document storage, event management, violation tracking, and maintenance request handling. We may update or modify features at any time to improve the service.
3. Accounts and Access
You are responsible for maintaining the security of your account credentials. Each user must have their own account. HOA administrators control role assignments and permissions for their organization's members. You must provide accurate information when creating an account and keep it up to date.
4. Subscription and Billing
Small HOA offers paid subscription plans based on community size. Subscriptions are billed monthly or annually as selected at signup. Your subscription renews automatically unless cancelled before the renewal date. We offer a 30-day free trial for new accounts. Prices may change with 30 days' notice. Refunds are handled on a case-by-case basis.
5. Your Data
You retain ownership of all data you upload or enter into the platform, including member information, financial records, documents, and communications. We do not claim any ownership rights to your content. You are responsible for ensuring you have the right to upload and share any content you add to the platform. You may export your data at any time.
6. Acceptable Use
You agree not to use the platform to store or transmit illegal content, send unsolicited communications to non-members, attempt to access other organizations' data, interfere with the platform's operation, or reverse-engineer any part of the service. HOA administrators are responsible for ensuring their community's use of the platform complies with applicable laws and their governing documents.
7. Payment Processing
Dues payments between HOAs and homeowners are processed through Stripe. Small HOA does not store credit card numbers or bank account details directly. Payment processing is subject to Stripe's terms of service. HOAs are responsible for the accuracy of invoices and payment amounts. Small HOA is not a party to financial transactions between an HOA and its members.
8. Termination
You may cancel your subscription at any time from your account settings. Upon cancellation, your account remains accessible through the end of the current billing period. We may suspend or terminate accounts that violate these terms. After account termination, your data will be retained for 30 days to allow for export, after which it will be permanently deleted.
9. Limitation of Liability
Small HOA is provided "as is" without warranties of any kind. We are not liable for any disputes between HOAs and their members, decisions made using information from the platform, interruptions in service, or indirect or consequential damages. Our total liability is limited to the amount you paid for the service in the 12 months preceding any claim.
10. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes via email or through the platform at least 30 days before they take effect. Your continued use of the platform after changes take effect constitutes acceptance of the updated terms.
